چکیده:
مالکیت بر منابع نفت و گاز از جمله مباحثی که اختلافات زیادی در حوزه تلقی از مالکیت و اموال عمومی به وجود آورده است به نظر عده ای مالکیت بر منابع نفت و گاز از حوزه مالکیت عمومی و عده ای نیز معتقدند که این نوع مالکیت در حوزه مالکیت خصوصی و عده قلیلی نیز معتقدند که این نوع مالکیت نه عمومی و نه خصوصی بلکه طرقی میانه را در این مسیر برگزیده اند. با توجه به بحث های صورت گرفته در حوزه اختیارات دولت نسبت به منابع طبیعی باید گفت که دولت ها در حوزه اموال عمومی قائل به اختیار نسبی می باشند به این صورت که استفاده از اموال عمومی نباید به اندازه ای باشد که باعث آسیب به منابع طبیعی دیگر کشورها شود به عبارت دیگر استفاده از این منابع باید حالت طبیعی و مشروع داشته باشد.
Ownership of the oil and gas includes disputes in the field of ownership and public properties. Some people believe that ownership of oil and gas is related to public ownership and the others believe that this kind of ownership is related to the area of private ownership and a few people believe that this kind of ownership is not public and private but it is between these two kinds of ownership .With regards to disputes about scope of the powers of the state to natural sources ,it can be noted that states have relative authority in the area of public properties so that public properties should not cause harm to natural resources of other countries . In other words, using of these resources must be legal and natural.
